1.2 About These Terms

These Terms and Conditions apply to purchases made through The Fabric Story Studio website. Please read them carefully before placing an order. By placing an order, you agree to be bound by these Terms. Nothing in these Terms excludes, restricts or otherwise affects statutory rights that cannot lawfully be excluded or restricted.

1.3 Our Products

· haberdashery;

· trimmings;

The availability of particular products may change from time to time.

1.4 Product Descriptions

We take reasonable care to ensure that product descriptions, photographs, dimensions, measurements, fibre-composition information, prices and other information are accurate. Customers should read the complete product description before purchasing. Material characteristics relevant to a purchasing decision should be displayed clearly before the customer places an order.

1.5 Fabric Characteristics

Textiles may display natural or manufacturing characteristics. Depending on the fabric and production process, these may include minor variations in colour, print registration, surface texture, weave, finish, pattern placement, motif placement and production batch or dye lot. Where a fabric is part of a heritage, traditionally produced or specialist textile collection, characteristics associated with the production method may occur. We will not knowingly describe a material defect as a normal characteristic. Statutory rights remain unaffected.

1.6 Fabric Sold from a Bolt or Roll

Some fabrics are supplied by cutting the quantity selected by the customer from a bolt or roll. The relevant product page should identify, where applicable, the unit of sale, fabric width, quantity selected, whether multiple units are normally supplied as one continuous length, whether the fabric is pre-washed or unwashed, fibre composition and relevant care or product-specific information. Customers are responsible for checking the selected unit and quantity before placing an order.

1.7 Continuous Lengths

Where a product page states that multiple units will normally be supplied as one continuous length, we will use reasonable efforts to do so. Where available stock cannot be supplied as one continuous length, we will not knowingly substitute separate pieces without contacting the customer where the difference would materially affect the order.

1.8 Fabric Width and Measurements

Fabric width will be stated on the relevant product page where applicable. Measurements are provided as accurately as reasonably possible. Textile goods may be subject to minor tolerances arising from manufacture, finishing, washing, handling or cutting.

1.9 Pre-Washed and Unwashed Fabric

Some products may be pre-washed while others are supplied unwashed. The relevant product page should state the condition in which the product is supplied. Customers should not assume that fabric has been pre-washed unless expressly stated. Natural-fibre fabrics may shrink, release colour or change in handle or appearance following washing. Where pre-washed fat quarters or half-metre cuts are sold, this should be identified. Where metre-length fabric is supplied unwashed from a bolt or roll, this should be identified.

1.10 Colour Representation

We take reasonable care to represent colours accurately. Colours may appear differently because of screen calibration, device type, brightness, display settings, ambient lighting, photography and production-batch or dye-lot differences. Minor screen-to-product differences are not necessarily defects. This does not affect statutory rights where a product is materially misdescribed.

1.11 Pattern and Motif Placement

Pattern and motif placement may vary from one cut to another. A product photograph is representative of the design and colourway and does not guarantee a particular motif position unless expressly agreed otherwise.

1.12 Dye Lots and Production Batches

Differences may occur between production batches or dye lots. Customers undertaking a single project should consider ordering sufficient fabric at one time because a later order cannot be guaranteed to come from the same batch or dye lot.

1.13 Fibre Composition and Textile Information

Where required, textile fibre-composition information will be provided in accordance with applicable law. Customers should refer to the product page and any product labelling or packaging for composition information.

1.14 Sewing Machine Parts

Customers purchasing sewing machine parts are responsible for checking compatibility information before ordering. Where compatibility depends on a machine make, model, series, part number, fitting, size or technical specification, the customer should check the product description carefully and contact us before ordering if uncertain. Statutory rights remain unaffected where goods are faulty, unsafe, misdescribed or otherwise non-conforming.

1.15 Product Safety

We aim to supply products that comply with applicable product-safety requirements. Customers should follow manufacturer instructions, warnings, age restrictions, installation instructions, care instructions and safe-use guidance where applicable. Sewing machine parts should be fitted and used in accordance with manufacturer guidance and by a competent person where specialist installation is required.

1.16 Placing an Order

Our website will guide you through the ordering process. Before submitting an order, check the product, design, colourway, size, unit of sale, quantity, compatibility where applicable, delivery address and total price. You are responsible for ensuring information supplied with the order is accurate.

1.17 Order Acknowledgement and Contract Formation

After placing an order, you may receive an automated acknowledgement confirming receipt. An acknowledgement does not necessarily mean we have accepted the order. A legally binding contract is formed when we expressly accept the order, for example through the order-confirmation or dispatch-confirmation process stated in the relevant communication.

1.18 Our Right to Decline an Order

We may decline or cancel an order before acceptance where a product is unavailable, a price or material description contains an obvious error, payment cannot be authorised, we reasonably suspect fraud or misuse, delivery is unavailable, a legal restriction prevents fulfilment, or we cannot reasonably fulfil the order as placed. If payment has been taken for an order we cannot fulfil, we will refund the relevant amount.

1.19 Prices

Prices are displayed in pounds sterling unless otherwise stated and will be presented in accordance with applicable law. Where VAT is applicable, pricing will reflect applicable requirements. Mandatory charges that can reasonably be calculated in advance will be disclosed as required. Delivery charges will be shown before commitment to purchase where applicable.

1.20 Payment

Available payment methods will be displayed at checkout. Payment processing may be carried out by third-party payment service providers. You confirm that you are authorised to use the submitted payment method.

1.21 Delivery

Available delivery methods, charges and estimated timescales will be shown on the website or at checkout. Estimates are not guaranteed unless expressly stated. We will comply with applicable consumer law concerning delivery times and responsibility for goods in transit. Customers are responsible for providing a complete and accurate delivery address.

1.22 Risk in the Goods

For consumer purchases, risk passes in accordance with applicable law. Where we arrange delivery using a carrier offered by us, responsibility for risk remains governed by consumer law until the goods come into the physical possession of the customer or a person identified by the customer to take possession.

1.23 Statutory Right to Cancel Distance Purchases

For many goods purchased online, consumers have a statutory right to cancel without giving a reason. Where the right applies, the cancellation period generally expires 14 days after the day on which the consumer, or a nominated person other than the carrier, acquires physical possession, subject to applicable rules. To cancel, send a clear statement to info@fabricstorystudio.co.uk or by post to Sew And Save Limited, trading as The Fabric Story Studio, 10 St Abbs Court, Milton Keynes, MK4 3FW, United Kingdom. A customer may use the model cancellation form in the Returns Policy but is not required to do so.

1.24 Fabric Cut from a Bolt or Roll and Statutory Exceptions

UK law provides exceptions to the statutory cancellation right for certain categories of goods, including goods made to the consumer’s specifications or clearly personalised. Some products may be prepared or cut in response to selected requirements. However, The Fabric Story Studio does not rely on a blanket statement that every ordinary length of fabric cut from a bolt or roll automatically falls within the statutory exception. Where a product genuinely falls within an exception, the position will be assessed according to the product and circumstances and communicated clearly before purchase where required. Statutory rights for faulty, damaged, unsafe, misdescribed or non-conforming goods remain unaffected.

1.25 Returning Goods Following Cancellation

Where a statutory cancellation right applies and the customer validly cancels, goods must be returned in accordance with applicable law and the Returns Policy. Unless we offer to collect, the customer is responsible for returning them. Where legally permitted and properly disclosed before contract, the customer may be responsible for direct return costs.

1.26 Handling Returned Goods

Customers may inspect goods to the extent reasonably necessary to establish their nature, characteristics and functioning. Where permitted by law, reimbursement may be reduced for diminished value caused by handling beyond what is necessary for that purpose.

1.27 Refunds Following Statutory Cancellation

Where a customer validly exercises a statutory cancellation right, reimbursement will be provided in accordance with applicable law. Where required, this includes the price paid and the cost of the least expensive standard delivery method offered. Additional delivery costs from a more expensive selected method may not be refundable where law permits.

1.28 Faulty, Damaged or Misdescribed Goods

Nothing in these Terms limits statutory consumer rights. If goods are faulty, damaged, unsafe, not as described, not of satisfactory quality, unfit for a relevant purpose where applicable or otherwise non-conforming, contact info@fabricstorystudio.co.uk. We may request photographs or other reasonable information to investigate, but this does not restrict statutory rights.

1.29 Incorrect Product or Quantity

If we send the wrong fabric, design, colourway, product, part, size or quantity, contact us promptly. Verified fulfilment errors will be addressed in accordance with applicable law.

1.30 Care, Washing and Use

Customers should follow applicable care guidance. Where relevant, consider pre-washing before making a finished item, wash colours separately where appropriate, allow for possible shrinkage, test where colourfastness is critical, follow temperature and washing instructions, and do not assume different product types have undergone identical finishing. We are not responsible for damage caused by misuse or failure to follow clearly provided care instructions, except where law provides otherwise.

1.31 Promotions and Discount Codes

Promotions may be subject to separate terms. Unless otherwise stated, discount codes cannot be exchanged for cash; expiry dates, exclusions, non-combination rules and minimum-spend conditions may apply. Promotions do not remove statutory rights.

1.32 Reviews and Customer Content

Where customers submit reviews or other content, submissions must not be unlawful, defamatory, fraudulent, misleading or infringe another person’s rights. We will not knowingly present fake reviews as genuine. Any claim about review verification will reflect the actual process.

1.33 Intellectual Property

Unless otherwise stated, original content created for The Fabric Story Studio website, including original text, branding, graphics, photography and editorial material, is owned by or licensed to Sew And Save Limited and protected by applicable intellectual-property law. Third-party trademarks, textile designs, product names and other intellectual property remain the property of their respective owners.

1.34 Website Availability

We aim to keep the website available and accurate but cannot guarantee uninterrupted or error-free operation. We may update, suspend or modify parts of the website where reasonably necessary.

1.35 Liability

Nothing in these Terms excludes or limits liability where unlawful to do so or excludes statutory consumer rights. Subject to applicable law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer purchase.

1.36 Events Outside Our Reasonable Control

We will not be responsible for delay or failure caused by events outside our reasonable control to the extent permitted by law. Where such an event affects an order, we will take reasonable steps to minimise the effect and communicate where appropriate.

We may update these Terms from time to time. The version applying to a purchase will generally be the version in force when the relevant contract was made.

1.39 Governing Law

These Terms and any contract between you and us are governed by the laws of England and Wales. If you are a consumer resident in another part of the United Kingdom, you may also benefit from mandatory consumer-protection rights that apply in your place of residence. Nothing in these Terms is intended to deprive a consumer of mandatory legal protections that cannot lawfully be excluded.

1.40 Jurisdiction

Subject to mandatory consumer rights concerning where proceedings may be brought, the courts of England and Wales will have jurisdiction in relation to disputes arising from these Terms or a contract between you and us. A consumer resident in Scotland or Northern Ireland may also have rights to bring proceedings in courts available under applicable law.
